- Our practices for collecting, using, maintaining, protecting, and disclosing that information.
This policy applies only to information we collect via the Apps, Website, our Services and email and other electronic communications sent through the Apps and Website. The defined terms in this Policy have the same meaning as ascribed to them in the Terms of Use.
Please read this Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, or use our Apps, Website, or Services. By downloading, registering with, or using our Apps, Website, or Services, you agree to this Privacy Policy. This Policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of the Apps, Website, or Services after we revise this Policy means you accept those changes, so please check the Policy periodically for updates.
Children Under the Age of 13
The Apps, Website, or Services are not intended for children under 18 years of age. We do not knowingly collect personal information from children under 13. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at support@playreplay.io.
Information We Collect
The types of personal information we obtain about you depends on how you interact with us and our Apps, Website, and Services. When we use the term “personal information,” we are referring to information that identifies, relates to, describes, or can be associated with you. The following are the categories and specific types of personal information that we may collect:
Basic Identifying Information
Including your full name, alias, e-mail address, account name, club affiliation, other similar identifiers.
Biometric Information.
Physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as, height, gait, or other physical patterns (sleep, health, and exercise data).
Device Information and Other Unique Identifiers
Including device identifiers, internet protocol (IP) address, cookies, beacons, pixel tags, mobile ad identifier, or similar unique identifiers.
Internet or Other Network Activity
Including browsing or search history and information regarding your interactions with our Sites, emails, or advertisements.
Geolocation Data
Including information that permits us to determine your location, such as if you manually provide location information or enable your mobile device to send us precise location information.
Payment Information
Including credit or debit card numbers.
Commercial Information
Including services that you have used.
Physical Characteristics
Including height, weight and handedness.
Demographic Data
Including age and gender.
User Content
Including your communications with us and any other content you provide (such as social media profiles, photographs, images, videos, and survey responses, etc.).
Audio and Visual Information
Including photographs, images, and videos as recorded by our cameras when you use our product and/or play with someone who uses our Services.
Inferences
Inferences drawn from or created based on any of the information identified above.
Sensitive Personal Information
We only collect sensitive personal information, as defined by applicable privacy laws, for the purposes allowed by law or with your consent. We do not collect or process sensitive personal information for the purpose of inferring characteristics about you.
How We Collect Your Personal Information
We collect information from and about users of our Apps, Website and Services:
Directly from you when you provide it to us.
We may collect personal information you provide, such as when you register for an Account, access our Services via Apps (on your mobile device or from devices that are pre-loaded with our Apps and are available courtside) or Website, or interact with us.
Information We Collect Through Automatic Data Collection Technologies
When you download, access, and use the Apps, or use the Website it may use technology to automatically collect:
- Usage Details. When you access and use the Apps, Website, or Service, we may automatically collect certain details of your access to and use of the Apps, Website, or Service, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the Apps, Website, or Service.
- Device Information. We may collect information about the device from which you access our Apps or Website and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information, and the device’s telephone number.
- Stored Information and Files. The Apps also may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.
- Location Information. The Apps and the Service collects real-time information about the location of your device.
If you do not want us to collect this information do not download the Apps or use our Service, or delete the Apps from your device, or you may opt out at any time by OPT-OUT METHOD. For more information, see Your Choices About Our Collection, Use, and Disclosure of Your Information, however, that opting out of the Apps' collection of location information will disable its features.
The technologies we use for automatic information collection may include:
- Cookies (or mobile cookies). A cookie is a small file placed on your smartphone. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your mobile device. However, if you select this setting you may be unable to access certain parts of our Apps or Services.
- Web Beacons. Pages of the Apps, Website and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related app statistics (for example, recording the popularity of certain app content and verifying system and server integrity).
How We Use Your Information
We use information that we collect about you or that you provide to us, including any personal information, to:
- Provide you with the Apps, the Website, The Services, and its contents, and any other information, products, or services that you request from us.
- Fulfill any other purpose for which you provide it.
- Give you notices about your account/subscription.
- Carry out our obligations and enforce our rights arising from any contracts entered into between you and us.
- Share your information with our partners and vendors for advertisement and marketing purposes.
- Notify you when Apps updates are available, and of changes to any products or services we offer or provide though it.
The usage information we collect helps us to improve our Apps and Services and to deliver a better and more personalized experience by enabling us to:
- Estimate our audience size and usage patterns.
- Store information about your preferences, allowing us to customize our Apps according to your individual interests.
- Speed up your searches.
- Recognize you when you use the Apps.
We use location information we collect to provide you with the services.
Disclosure of Your Information
We may disclose aggregated information about our users, and information that does not identify any individual or device (mobile or from devices that are pre-loaded with our Apps), without restriction.
In addition, we may disclose personal information that we collect or you provide:
- To our subsidiaries and affiliates.
- To contractors, service providers, and other parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them. This includes, our payment partners like Stripe, you provide personal information in connection with your subscription account, Stripe receives that personal data and processes it in accordance with Stripe’s Privacy Policy.
- To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of PlayReplay’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by PlayReplay about our users is among the assets transferred.
- To fulfill the purpose for which you provide it.
- For any other purpose disclosed by us when you provide the information.
- With your consent.
- To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
- To enforce our rights arising from any contracts entered into between you and us.
- If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of PlayReplay, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
Your Choices About Our Collection, Use, and Disclosure of Your Information
We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of over your information.
- Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. You can choose whether or not to allow the Apps or Website to collect information through other tracking technologies by sending an email to support@playreplay.io . If you disable or refuse cookies or block the use of other tracking technologies, some parts of the Apps or Website may then be inaccessible or not function properly.
- Location Information. You can choose whether or not to allow the Apps and/or Service to collect and use real-time information about your device's location through the device’s privacy settings or by adjusting the setting of your website browser. If you block the use of location information, some parts of the Apps or Website may become inaccessible or not function properly.
We do not control third parties' collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.
We do not sell your personal information as defined under Nevada law. However, to request email confirmation that we do not sell your personal information, please send an email to support@playreplay.io with “Nevada Opt-Out of Sale” in the subject line and in the body of your message. We will provide the requested information to you via an email response.
Your Rights
The Right to Limit the Use of Sensitive Personal Information
As mentioned above, PlayReplay only collects sensitive personal information, as defined by applicable privacy laws, for the purposes allowed by law or with your consent. PlayReplay does not collect or process sensitive personal information for the purpose of inferring characteristics about you.
Some of the purposes for the collection and processing of sensitive personal information allowed by law include: to perform the services or provide the goods reasonably expected; to prevent, detect, and investigate security incidents; to resist malicious, deceptive fraudulent, or illegal actions directed at PlayReplay and to prosecute those responsible for those actions; to ensure the physical safety of natural persons; for short-term, transient use; to perform services on behalf of PlayReplay; and to verify or maintain the quality or safety of a product or service provided by PlayReplay.
Therefore, PlayReplay does not offer the right to limit the use of sensitive personal information.
The Right to Access, Correct, Opt-Out and Delete Personal Information
Depending on your state of residence in the U.S., you may have the right to request access to and receive details about the personal information we maintain about you and how we have processed it, correct inaccuracies, get a copy of, or delete your personal information. You may also have the right to withdraw your consent to our processing of your personal information. These rights may be limited in some circumstances by applicable law.
Access, Correct, Out-out, and Deletion You can submit a request to access, correct, oup-out or delete your personal information, or withdraw consent, by:

Typically, we retain your personal information for the period necessary to fulfill the purposes outlined in this privacy policy, unless a longer retention period is required or permitted by law. Please note that in many situations we must retain all, or a portion, of your personal information to comply with our legal obligations; resolve disputes; enforce our agreements; protect against fraudulent, deceptive, or illegal activity; or for another one of our business purposes.
Responding to Requests Once you have submitted your request, we will respond within the time frame permitted by the applicable law. Please note that we may charge a reasonable fee for multiple requests in the same 12-month period, as permitted by law.
Appealing Requests Depending on your state of residence in the U.S., you may be able to appeal our decision to your request regarding your personal information. To do so, please contact us in any of the ways listed in the "Contact Information" section. We respond to all appeal requests as soon as we reasonably can, and no later than legally required.
Identity Verification For us to process some requests, we will need to verify your identity to confirm that the request came from you. We may contact you by phone or e-mail to verify your request. Depending on your request, we will ask for information such as your name or an e-mail address that you have used with PlayReplay.
Authorized Agent Depending on your state of residence in the U.S., you may designate an authorized agent to submit a request on your behalf to access or delete your personal information. To do so, you must: (1) provide that authorized agent written and signed permission to submit such request; and (2) verify your own identity directly with us. Please note, we may deny a request from an authorized agent that does not submit proof that they have been authorized by you to act on your behalf.
California's "Shine the Light" law
California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Apps or Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Changes to Our Privacy Policy
We may revise this Privacy Policy from time to time and will post the date it was last updated at the top of this Privacy Policy. We will provide additional notice to you if we make any changes that materially affect your privacy rights.
